Terms & Conditions

Please kindly review these Terms & Conditions before making your tour booking. By making a booking with us, you are deemed to have read, understood and accepted these Terms and Conditions.

Booking, Deposit and Full Payment

  • To book a tour package with us, you are required to place a deposit for yourself and every accompanied person travelling with you on the tour package.
  • This deposit will form part of your final payment. The minimum deposit is specified in the table below. You will be notified should a higher deposit is required for your specific booking.
  • To confirm your tour booking, you must also submit to us a clear photocopy of the front page passport details for every person in your travel group within 3 days of the deposit payment.

  • Payment of the deposit and confirmation of the booking does not constitute confirmation for the tour package.
  • All tour packages are subject to a minimum group size especially for Group Tours (Ex-BKI) (to be determined by us in absolute discretion) before the tour package is confirmed. If the minimum group size is not achieved at least 21 days before the scheduled departure date for a tour package, we shall be entitled to cancel all bookings for the tour. Deposit paid is non-refundable, however it can be transferred for your next tour booking, whereby it must be used within 12 months from the day your deposit is paid.
  • We will notify you as soon as possible once your tour has been confirmed. Unless otherwise agreed or notified by us following confirmation of you tour package.
  • You must make full payment (balance payment) for your tour package at least 21 days (2 To Go Package) or at least 45 days (Group Tour Package) or otherwise indicated for any specific tour before the designated departure date.
  • If you fail to make full payment by the deadline, we shall be entitled to cancel your booking and a cancellation fee will be imposed. The deposit will then be applied toward the settlement of the cancellation fee, with any balance owing to be payable within 7 days, without any recourse by you against us.

Cancellation by Customer

  • You may cancel your tour booking in writing either by email or fax at any time before the designated tour departure date, subject to payment of a cancellation fee to us, to be computed based on the table below.
  • In such event, you shall additionally be responsible for any non-refundable airport taxes and any miscellaneous surcharges by the airline(s).
  • Please note that any change of departure date, guest’s name (other than typographical errors correction) or tour package is considered a cancellation and a cancellation fee will apply.

  • Airline ticket cancellation is subject to the airline’s cancellation policy and any charges shall apply in addition to the cancellation charge as set out in the table above.
  • Ticket may be non-endurable, non-reissueable, non-refundable and non-rerouteable. Any alteration in routing or change of date of travel by any guest is solely at his own risk.
  • The company or its associated agents shall not be held responsible for any inconvenience caused and extra expenses incurred.
  • You will be notified of the amount of the cancellation charge payable as soon as possible following the cancellation of the booking. Should the deposit be insufficient to meet the cancellation charge, you must settle the shortfall within 3 days of such notification.

Cancellation by Company

  • Please note that the Company is merely acting as an intermediary to engage the services of third party service providers in respect of your tour package. Even after full payment for a tour package has been made, all tour package arrangements are still subject to final confirmation by the relevant third party service provider(s). 
  • We shall endeavour to notify you, at least 14 days before the scheduled departure date, if due to any unforseen circumstance(s), any tour package arrangement cannot be finalised, insufficient number of people to form a minimum group tour size, inability to secure airline seats or accommodations, arrangements that need to be changed by us, or your booking has to be cancelled.
  • In such case, we may, but shall not obliged to recommend alternative tour packages to either the same or different destination. Additional charges may apply for such alternative tour packages and you will be advised accordingly of all such charges before having to make any election. If no alternatives are offered or should you decide not to accept any alternative offered, we will fully refund all payments received from you for the tour package (without interest), in full discharge of our obligations to you.

Amendments by Customer

  • You may submit a written request for an amendment to the details of a booking, such as rectification of typographical errors in a guest’s name, changes to flight itinerary and hotel accommodation, at any time. We will accommodate or facilitate your request but cannot guarantee you that it can be effected.
  • You may not be able to effect any change to certain arrangements, such as the issue of special fare or promo fare air ticket.
  • Air ticket and hotel accommodation amendments are subject to third party amendment policy. Where the amendment is possible, you shall be responsible for all additional charges and administrative fees that may be incurred to effect the amendment.
  • We will endeavour to confirm the status of any request fo an amendment within 14 days of receving the written request.

Refund Policy on Unused Services

  • No refund, either in full or in part, will be made with respect to all arrangements for accommodation, meals, sightseeing tours or other services which are included in the tour package fare but not utilised or unused by the guest, or where the guest amends, cancels or otherwise varies such arrangement after the commencement of the tour package.
  • If, after a tour package has departed, any service(s) in the itinerary cannot be fulfilled or any change(s) to the itinerary are necessitated for any reason(s) beyond our control, especially during peak seasons or upon the occurrence of a force majeure event, such as an act of God, earthquake, fire, tsunami, or other natural disasters, weather conditions, war, civil unrest or terrorist attacks, government or legislative actions, strikes and labour unrest, diseases or pandemics, compulsory quarantines, or other similar event(s), we reserve the right to make reasonable changes to the itinerary, but shall endeavour where possible to arrange for the provision of a comparable alternative service. Any additional expense resulting from such changes shall be payable by you and any resulting saving will be refunded by us to you. Should you reject our offer of an alternative service, we shall not be obliged to refund any fee paid by you in respect of the unfulfilled or unused service(s), but may do so, on a case-by-case basis.

Extensions of Stay or Deviations

  • Any request for an extension of stay or deviation from the tour package itinerary must be in writing and may be permitted, on the terms below, subject to applicable validity periods, restrictions on air tickets or seat confirmation, and availability of accommodation.
  • We will endeavour to accommodate your request but cannot assure you that it can or will be effected. If, for any reason, we are unable to confirm your request at least 14 days before the designated departure date, the request shall be deemed withdrawn and you shall be deemed to have consented to the original itinerary.
  • Any extension or deviation will be at your own expense and separate transfer services to and from the airport will not be provided. All extra costs (including a reasonable administrative fee, to be determined in our discretion) incurred to process the request for an extension or deviation will also be borne by you.
  • Any alteration of the route or the flight date by you is solely at your own risk, and we and our associated agents shall not be held responsible for any inconvenience caused or extra expense incurred.

Travel Document

  • Each guest is solely responsible for ensuring that his or her passport or other travel document is valid for at least 6 months from the expected departure date from the last point of departure in the itinerary.
  • Each guest must prepare all necessary visas, permits, passes, licenses, vaccinations, health certificates and/or other documents or approvals as may be required by the applicable governmental authorities of the destination country(ies) in the tour package.

Visa

  • Our company may assist a guest to submit a visa application for a fee, but do not guarantee the outcome or approval of any such application. Different embassies or consulates require varying lengths of time to process visa applications and, accordingly, any traveler seeking our assistance to apply for a visa must check with us as soon as possible on the applicable visa requirements.
  • Currently we only assist in Visa Application for Australia, China, and Canada.

Travel Insurance

  • All guests are strongly advised to prepare a comprehensive travel insurance policy to protect against unforeseen circumstances such as baggage loss, flight delays, and medical emergencies. We shall not be responsible, under any circumstances, for any such matters. Please contact us if you wish to purchase a comprehensive travel insurance from us.

Tour Package General Matters

Accommodation

  • Accommodation at nominated hotels is as specified in the tour package itinerary and based on the country’s local standard hotel accommodation.
  • Accommodation is generally available on either a Twin Share, Double Share, Single Room occupancy or Triple Share basis. Single room occupancy is usually at additional cost.
  • Accommodation at ski resort and farm stay may be based on sharing bathroom facilities.
  • For Triple Share room in some countries, the third bed may be a “roll-away” extra bed.
  • Accommodations are subject to change due to unforeseen circumstances beyond our control and jurisdiction without prior notice.

Meals

  • Meals, including on-board flight meals, are indicated as the tour package itinerary. Meals indicated in the itinerary are for information purposes only and are subject to change without prior notice.
  • No refunds will be given if the on-board flight meals are not served for any reason.
  • If a meal indicated in the tour itinerary is not served, an alternative meal will be provided.
  • Most meals are based on local flavors or local specials in that specific area of a country.
  • Halal meals indicated in the tour itinerary (for Halal Muslim tour) will be served in a Halal certified restaurant. However, not all meals will be Halal as Halal restaurants are limited in overseas. In this case, seafood and vegetarian meals will be served instead in a Muslim-friendly restaurant (not labeled as Halal restaurant).

Tour Itinerary

  • Tour itinerary is subject to change due to unforeseen circumstances (including weather, traffic condition, local political uncertainties) beyond our control and jurisdiction without prior notice. 
  • If for any reason a place of visit is closed or subject to weather conditions, tour will proceed with another destination for alternative.

Baggage Handling/ Loss or Damaged Baggage

  • Free check-in baggage allowance is provided by the airlines and the conditions may differ from airline to airline. This also applies to hand-carried baggage aboard the aircraft. Please check with us for the baggage allowance before your scheduled departure date.
  • Excess baggage must be paid locally in the departing country by the guests themselves.
  • We will not be responsible for any loss, damage or theft of any item(s) belonging to a guest throughout the duration of the tour. However, if a baggage did not arrive to the destination on time, we shall endeavour but shall not be obliged, to arrange the baggage to be sent to the destination within 2 days, depending on the available flights. This only applies to Group Tour packages. We will not be responsible for any delay or loss baggage for 2 To Go Tour package.

Mileage Accrual

  • We may help you to enter your frequent flyer membership programme(s) for mileage accrual if you purchase air ticket with us or through our ticketing partners. However, we will not be responsible and we do not provide any after-service for any missing mileage under any circumstances.

Travelling with Minors

  • Guest under 18 years of age (as at the scheduled departure date) must be accompanied by an adult.
  • If any guest under 18 years of age is travelling with an adult other than his or her parent or official guardian, his or her parent or official guardian is required to write a consent letter to us.

Special Request

  • It is the guest’s sole responsibility to inform our company of any special request that he or she may have, such as special dietary requirements, special seating arrangements, request for adjoining rooms, request for smoking room, wheel chair assistance etc. at the time of booking.
  • All requests are subject to availability and confirmation, and we will not be responsible if any such request is not or cannot be met for any reason.

Pregnancy

  • It is the responsibility of the guests who are pregnant to ensure that they have a doctor’s certification that they are fit for travel. Notwithstanding any such doctor’s certificate, third party providers, such as airlines or cruises, have the sole discretion to disallow a pregnant traveler to board the flight or cruise ship or to undertake certain activities and no refund shall be payable in such event.

Special Needs Guests

  • We will use reasonable endeavours, but shall not be obliged, to accommodate the special needs of disabled guests and shall not be responsible if we are unable to effect any requested arrangements.
  • We shall also not responsible for any denial of services by airlines, hotels, restaurants or other third party service providers. We cannot provide individual assistance to any traveler for walking, dining, getting on or off motor coaches, cruise ships and other vehicles, or other personal needs.
  • A qualified and physically able-bodied companion must accompany guests who need such assistance and must assume full responsibility for their well-being.
  • We are not responsible for any missed activities due to a guest’s inability to participate in such activities.
  • We regret we must reserve the right to refuse to allow an individual to travel if he or she, in our reasonable opinion, is physically or mentally unfit to travel, or will or may require care beyond that which any travelling companion or we can generally provide in connection with the tour package, and no refund shall be payable in such event.

Pricing Policies

Validity

  • All tour prices shown are within the validity period as indicated in the tour itinerary.
  • Due to fluctuations in the foreign currency exchange rate, there will be price adjustments to all our existing products without prior notice.

Tour Package Inclusions

  • Group Tour package includes air ticket (international or domestic sector if any), accommodation, airport transfers (if any), meals (if any), local tour guide, coach transport as indicated in the tour itinerary.
  • 2 To Go Tour package includes accommodation, airport transfers (if any), meals (if any), local tour guide, Seat-In-Coach (SIC) or private transport as indicated in the tour itinerary.

Tour Package Exclusions

  • Tour package excludes tour guide and driver tipping, airport taxes, airport security taxes, airline surcharges, fuel taxes, visa fees, travel insurance, laundry services, room service, hotel porter fee, any other personal expenses.
  • Please check with us for general information regarding visa fees, tour guide and driver tipping practices.

Child Fare

  • Children below the age of 12 years (as of the date of return to Malaysia) may be eligible for Child Fare rates in accordance with the applicable third party service provider’s standard terms.
  • Child With Bed, is for children below 12 years old staying with two paying adults (twin/ double share) with an additional bed.
  • Child No Bed, is for children below 12 years old staying with two paying adults (twin/ double share) without additional bed.
  • Child With Adult, is for children below 12 years old staying with one paying adults (twin/ double share).

Rights and Disclaimers for Tours

We shall not be responsible or assume any liability to any guest for:

(a) any injury, damage, loss or delay affecting any person or property not arising from our own negligence or breach;

(b) any loss, damage, cost, expense or delay suffered or incurred due to circumstances beyond our reasonable control, including but not limited to:

  • (i) actions or omussions of third parties (including third party service providers);
  • (ii) mechanical breakdowns;
  • (iii) a Force Majeure Event;
  • (iv) a failure by the guest to comply with any of his or her obligations hereunder;
  • (v) a failure by the guest to posess, obtain or maintain any travel documentation required for the tour package (e.g. valid passports, visas, health certificate etc);
  • (vi) a failure by the guest to follow reasonable instructions, including but not limited to noting and complying with specified check-in and check-out and or meeting places and times.

In no event we shall be liable for any punitive, special, indirect or consequential loss or damage, including loss of production, profit, revenue or contract or loss of or damage to goodwill or reputation.

We reserve the right to withdraw any itinerary or any booking made and/or to decline or refuse any individual as a member of the tour, if it appears to us, in our absolute discretion, that such individual is likely to endanger the health or safety, or impair the comfort and enjoyment of the other members of the tour.

Confidentiality and Privacy

  • In compliance with the Personal Data Protection Act 2010, Eternal Holidays Sdn Bhd hereby inform you that your personal data collected from your registration with our tours will be
  • processed, retained and used by Eternal Holidays Sdn Bhd in relation to our tours.
  • Your personal data may also be retained and used by Eternal Holidays Sdn Bhd to market and promote other tour packages organised by Eternal Holidays Sdn Bhd or jointly with partners or supported by Eternal Holidays Sdn Bhd.
  • We may take photographs of guests participating in our tour packages for our advertising and publicity purposed (e.g. website and Facebook), all guests shall be deemed to have consented to such collection and/ or use on our part.

Miscellaneous

  • We reserve the right to change, amend, insert or delete any of these Terms and Conditions, or policies contained therein, from time to time.
